1. Acceptance of Terms (Incorporation by Reference)

By subscribing to Astrology by OMBRUJA (the “Service”), a mini app accessible at https://app.ombruja.com and built on Base, you (“Subscriber,” “you,” or “your”) agree to be legally bound by:

The Terms of Service and Privacy Policy are incorporated herein by reference and together with these Subscription Terms constitute a binding legal agreement between you and OMBRUJA LLC.

If there is any conflict between these Subscription Terms and the Terms of Service, the Terms of Service shall control.
If you do not agree to all applicable terms, do not subscribe to or use the Service.

2. Description of the Subscription Service

Astrology by OMBRUJA is a digital, time-based subscription service that provides Daily Horoscope reveals based on astrological data.

  • Subscribers may reveal one (1) Daily Horoscope per calendar day.

  • Daily Horoscopes update automatically according to the Subscriber’s local time zone.

  • Each Daily Horoscope is available only within its designated day window.

  • Once a day has passed, that specific Daily Horoscope expires permanently and cannot be accessed, recovered, or reissued.

  • The Service is experiential, non-cumulative, and time-locked.

3. Subscription Plan & Pricing

3.1 Monthly Subscription

  • Price: $5.00 USD (charged in USDC)

  • Billing Cycle: Monthly

  • Billing Timing: Automatically charged at the beginning of each billing month or on the date of initial subscription, as applicable.

3.2 Subscription Start Date

  • The subscription begins immediately upon successful payment confirmation.

  • Access to Daily Horoscopes is granted from that date forward.

  • No retroactive access is provided for days prior to the subscription start date.

4. Payment Authorization & Automatic Charges

By subscribing, you authorize OMBRUJA LLC to:

  • Automatically charge the designated wallet or payment method $5.00 USDC on a recurring monthly basis.

  • Continue charging until the subscription is canceled in accordance with these Subscription Terms and the Terms of Service.

You acknowledge and agree that blockchain-based transactions are irreversible once processed.

5. Failed Payments & Retry Policy

5.1 Payment Failure

If a scheduled payment fails for any reason (including insufficient funds, wallet errors, network issues, or provider failures):

  • Access to Daily Horoscope reveals will be temporarily suspended.

  • OMBRUJA LLC may attempt to reprocess payment up to three (3) times within a seven (7) day retry period.

5.2 During Retry Period

  • While payment remains unsuccessful, the Subscriber will not be able to collect the Daily Horoscope as part of the subscription.

  • During this period, the Subscriber may choose to unlock an individual Daily Horoscope for $0.25 USD per day, subject to availability and system functionality.

5.3 Subscription Termination for Non-Payment

If payment is not successfully processed within the retry period:

  • The subscription may be paused or terminated.

  • Continued access to subscription benefits requires successful payment.

6. Availability, Downtime & Technical Limitations

6.1 Service Availability

The Service relies on third-party infrastructure, including blockchain networks, hosting providers, APIs, wallet services, and related systems.

You acknowledge that:

  • Temporary outages, delays, or errors may occur.

  • Uninterrupted or error-free access is not guaranteed.

6.2 No Liability for Missed Daily Horoscopes

If a Subscriber is unable to access or reveal a Daily Horoscope due to:

  • Technical issues

  • Provider outages

  • Blockchain congestion

  • Maintenance

  • Force majeure events

  • Any circumstances beyond OMBRUJA LLC’s reasonable control

That Daily Horoscope is forfeited.
No refunds, credits, replacements, or extensions will be issued.

7. No Guarantees, Refunds, or Professional Advice

  • All subscription payments are final and non-refundable.

  • No refunds or credits are issued for unused days, downtime, missed access, or early cancellation.

Astrology content is provided for informational, entertainment, and personal reflection purposes only and does not constitute medical, legal, financial, investment, or professional advice. You agree not to rely on the Service as a substitute for professional guidance.

8. Communications & Notifications

By subscribing, you consent to receive communications from OMBRUJA LLC, including:

  • Subscription confirmations

  • Payment receipts

  • Billing notices

  • Service updates

  • Policy or account-related notifications

Communications may be delivered via email, in-app messages, or other digital channels associated with your account.

9. Eligibility & User Responsibilities

9.1 Eligibility

You must be at least 16 years old to subscribe to or use the Service.
By subscribing, you represent and warrant that you meet this requirement and are legally permitted to enter into binding agreements. Additional eligibility requirements, including sanctions and jurisdictional restrictions, are governed by the Terms of Service.

9.2 User Responsibilities

You are responsible for:

  • Maintaining a compatible wallet and sufficient funds

  • Ensuring accurate time zone information

  • Accessing the Service within the daily availability window

  • Securing your wallet and credentials

OMBRUJA LLC is not responsible for loss of access due to user error, wallet compromise, or incorrect configuration.

10. Intellectual Property

All content provided through Astrology by OMBRUJA — including text, artwork, branding, astrological interpretations, and system design — is the exclusive intellectual property of OMBRUJA LLC or its licensors and may not be copied, distributed, resold, or exploited without express written permission, except as permitted under the Terms of Service.

11. Disclaimers, Limits on Liability & Dispute Resolution

All disclaimers, limitations of liability, indemnification obligations, and dispute resolution provisions — including binding arbitration, jury trial waiver, class action waiver, and liability caps — set forth in the Terms of Service apply to these Subscription Terms and the Service and are incorporated herein by reference.

12. Governing Law

These Subscription Terms are governed by the laws of the State of New York, United States.
Disputes are resolved in accordance with the binding arbitration provisions set forth in the Terms of Service.

13. Modifications to the Service or Terms

OMBRUJA LLC reserves the right to:

  • Modify or discontinue the Service (in whole or in part)

  • Update pricing, features, or availability

  • Amend these Subscription Terms at any time

Material changes will be communicated via the app or email. Continued use of the Service constitutes acceptance of the updated terms.
